Welcome to Binky Academy app, which is owned and operated by Game Tunes MChJ. By purchasing a subscription for using Binky Academy including all of the services provided therein (Services), you acknowledge that you have read and understand these Terms, and agree to be bound by them. Game Tunes, MChJ is referred to as we, our, us, or the Company in these Terms.

In these Terms, "You" refers to Adult Users (as defined below) of the Services and purchasers of subscriptions (as defined below). An Adult is a person of legal age who can enter into a legal contract according to the legislation of the location in which You resides; by purchasing a subscription for using the Services of the binky Academy app, you represent and warrant that you are an Adult, and that you will be responsible for ensuring that any child or student authorized by you to use and access the Services does so in accordance with these Terms.

If you do not agree to each and every part of Binky Academy´s Privacy Policy, then you should not use the Services or submit any personally identifiable information through the Services.

The Service contains a variety of content including, without limitation: (i) software, technology, text, games, information, videos, photos, pictures, graphics, music, sounds, data, communications, illustrations, documentation, and other material and services that you can view on, access through, or contribute to the Service; (ii) trademarks, logos, trade names, service marks, and trade identities of Binky Academy; and (iii) other forms of intellectual property (all of the foregoing, collectively “Content”).

The Content is owned, controlled or licensed by Binky Academy, and is protected by law from unauthorized use.

You acknowledge that Binky Academy owns all intellectual property rights in and to the Content, including, without limitation, all patent rights, copyrights, inventions, trade secret rights, trade dress rights, trademark rights and intellectual property rights therein and thereto. You may not remove the copyright and other proprietary rights notices from the Content. You agree that this Terms of Service shall be retained with all printed and electronic copies of the Content and documentation constituting the Content. Binky Academy does not grant You any express or implied right in any patents, copyrights, trademarks, or trade secret information of Binky Academy.

You will acquire no right to use, and will not use without Binky Academy´s prior written consent, the names, characters, artwork, designs, branded names, copyrighted materials, trademarks or service marks of Binky Academy or its parent, related or subsidiary companies, employees, directors, officers, shareholders, assign, successors, licensors or licensees: (a) in any advertising, publicity, marketing, promotion or on any website; or (b) in any manner other than in accordance with this Terms of Service. You do not acquire any ownership rights over the Content by using the Services or downloading material from Binky Academy Apps.

You agree not to copy, redistribute, publish or otherwise exploit Content, except as expressly permitted herein, without the express prior written permission of Binky Academy.

FEES

Binky Academy requires a monthly payment of fees and/ or charges for the Services of Binky Academy Apps (hereinafter, the “Fees”). You hereby agree to pay all fees, including taxes, in accordance with these Terms of Service and the billing terms that are in effect at the time that the fee or charge becomes payable. Unless otherwise indicated, all prices are in US Dollars and do not include Internet service provider, telephone, and other connection charges.

Binky Academy reserves the right to change its fees or billing methods at any time. You acknowledge that Binky Academy may utilize certain third-party providers to collect or otherwise process the Fees.

Payment Options. You shall pay Fees using the payment methods, belonging to Binky Academy or third parties (“Payments Company”), and available for the particular Service and for your country of residence; and You agree to the terms and conditions applicable to each payment method You choose. Payment methods may vary by Service and by country. When You provide credit card or other payment information to Binky Academy or a Payments Company, You represent to Binky Academy or such Payments Company that You are the authorized user of the credit card or other payment methods.

Your subscription may start with a free trial. The duration of the free trial period of your subscription will be specified during sign-up and is intended to allow only new subscribers to try the service.

If you sign up for a trial subscription, your rights to use the Services are limited by the terms of such trial and will terminate or renew according to the terms of your trial arrangement.
